1. Acceptance of Terms

By accessing or using KioskScreen's services, website, and applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and KioskScreen, Inc. ("KioskScreen", "we", "us", or "our").

2. Eligibility

You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You are not barred from using the Services under applicable law
• If you are using the Services on behalf of an organization, you have authority to bind that organization

3. Account Registration

To access certain features of the Services, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

4.1 Subscription Plans

KioskScreen offers various subscription plans with different features and limitations. Current plans include:

• Free Plan: Limited to 10 screens with basic features
• Pro Plan: Unlimited screens with advanced features
• Enterprise Plan: Custom solutions for large organizations

4.2 Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or as explicitly stated
• We may change subscription fees upon notice to you
• You are responsible for all applicable taxes

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You will continue to have access until the end of your current billing period
• We do not provide refunds for partial months
• Your data may be deleted after a retention period

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Infringe intellectual property rights of others
• Upload or display content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to any part of the Services
• Interfere with or disrupt the integrity or performance of the Services
• Scrape, crawl, or use automated means to access the Services
• Resell or sublicense the Services without authorization
• Use the Services for any illegal or unauthorized purpose

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of any content you upload, post, or display on the Services ("User Content"). By uploading User Content, you grant us a limited license to:

• Host, store, and display your content
• Modify content for technical processing (transcoding, resizing, etc.)
• Distribute content to your authorized screens

6.2 Our Intellectual Property

All rights, title, and interest in and to the Services (excluding User Content) are and will remain the exclusive property of KioskScreen and its licensors. This includes:

• Software, code, and algorithms
• Designs, logos, and branding
• Documentation and content we create
• Patents, trademarks, and copyrights

6.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without restriction or compensation to you.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of information as detailed in the Privacy Policy.

8. Service Availability and Support

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted access
• We may perform maintenance with or without notice
• Support is provided according to your subscription plan
• We reserve the right to modify or discontinue features

9. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Services immediately ceases
• We may delete your account and associated data
• All provisions of these Terms that should survive termination will survive

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE SERVICE

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIOSKSCREEN SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
• SERVICE INTERRUPTIONS OR DATA LOSS
• ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100 IF YOU HAVE NOT PAID.

12. Indemnification

You agree to indemnify and hold harmless KioskScreen, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party right
• Your User Content

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in [Your Jurisdiction].

14. Changes to Terms
